These Terms and Conditions (“Terms”) govern your access to and use of the OperateProperty platform, including the Admin CRM, Tenant Portal, Owner Portal and all associated services (collectively, the “Service”), operated by OperateProperty (“we”, “us” or “our”). By registering for or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Who we are
Our website address is https://www.operateproperty.com. OperateProperty is a multi-tenant SaaS property management platform serving property managers, tenants and property owners worldwide.
2. Accounts and registration
To use the Service you must register for an account. You agree to provide accurate, complete and current information during registration and to keep that information up to date.
- You are responsible for maintaining the confidentiality of your login credentials.
- You are responsible for all activity that occurs under your account.
- You must notify us immediately at [email protected] if you suspect any unauthorised access to your account.
- Accounts are non-transferable. You may not sell, trade or transfer your account to another party without our prior written consent.
3. Acceptable use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not use the Service to:
- Violate any applicable local, national or international law or regulation.
- Transmit, store or distribute any content that is unlawful, defamatory, obscene, harmful, threatening, abusive or otherwise objectionable.
- Infringe the intellectual property rights of any third party.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- Collect or harvest data about other users without their explicit consent.
- Use the Service for any purpose other than legitimate property management operations.
4. Subdomain and workspace conduct
When you register, you are assigned a unique workspace subdomain (e.g. yourcompany.operateproperty.com). You agree that your chosen subdomain must not:
- Contain profane, offensive, derogatory or discriminatory language, slurs, or hate speech of any kind.
- Impersonate or mislead users into believing they are accessing a legitimate third-party brand, organisation or government body.
- Include terms designed to deceive, manipulate or mislead visitors.
- Be used for phishing, fraud or any other malicious purpose.
- Contain sexually explicit, violent or otherwise inappropriate content.
We reserve the right to reject, suspend or reassign any subdomain that we determine, at our sole discretion, violates these requirements or brings the platform into disrepute.
5. Free tier and plan limits
We offer a free Starter tier to allow individual property managers to evaluate the Service without a credit card. The free tier is subject to the following conditions:
One account per person or organisation. Creating multiple free accounts to circumvent plan limits — whether for yourself, your organisation or on behalf of others — is strictly prohibited and constitutes abuse of the Service.
- One free workspace per individual or organisation. You may not register multiple Starter accounts to work around limits on properties, units, users, documents or any other resource.
- Free tier accounts that are found to be duplicate registrations for the same individual or organisation will be suspended without notice.
- Free tier accounts that remain inactive for 90 consecutive days may be deactivated and their data scheduled for deletion. We will send a notice to the registered email address before any deletion occurs.
- We reserve the right to modify, restrict or discontinue the free tier at any time with reasonable notice.
6. Prohibited system abuse
The following actions constitute abuse of the Service and may result in immediate account suspension or permanent termination:
- Circumventing plan limits — using technical means, multiple accounts, or any other method to exceed the limits of your subscription tier.
- Automated account creation — using bots, scripts or automated tools to register accounts in bulk.
- Data scraping — extracting data from the Service through automated means without our prior written consent.
- API abuse — making excessive API calls that place unreasonable load on our infrastructure, or using the API to bypass rate limits or access controls.
- Reverse engineering — attempting to decompile, disassemble or otherwise derive the source code of the Service.
- Vulnerability exploitation — attempting to probe, scan or test the vulnerability of our systems, or exploiting any security weakness you discover. Security vulnerabilities must be reported responsibly to [email protected].
- Denial of service — attempting to disrupt, degrade or overload the Service or its underlying infrastructure.
- Injecting malicious code — uploading or transmitting viruses, malware, ransomware or any other malicious code through the Service.
- Tenant or owner data misuse — accessing, modifying or exporting tenant or owner data for purposes other than legitimate property management operations.
If you discover a security vulnerability in the Service, please report it responsibly to [email protected] before disclosing it publicly. We take security seriously and will work to resolve valid reports promptly.
7. Account suspension and termination
We reserve the right to suspend, restrict or permanently terminate your account at our sole discretion, with or without notice, if we determine that:
- You have violated any provision of these Terms.
- You have engaged in fraudulent, abusive or illegal activity on or through the Service.
- Your account is being used to harm other users, tenants, property owners or third parties.
- You have created multiple accounts to circumvent free tier limits or other restrictions.
- Your subdomain or account content violates our acceptable use or subdomain conduct policies.
- Your subscription payment has failed and remains unresolved after reasonable notice.
- Continued operation of your account would expose us or other users to legal, financial or reputational risk.
Upon termination, your right to access the Service ceases immediately. You remain responsible for all fees incurred up to the date of termination. For terminations caused by your breach of these Terms, no refund will be issued.
For voluntary cancellations, your account and data will be retained for 30 days following cancellation, during which you may export your data. After 30 days, your data will be permanently deleted from our systems.
8. Data and content you upload
You retain ownership of all data, documents and content you upload to the Service (“Your Content”). By uploading content, you grant us a limited, non-exclusive licence to store, process and display Your Content solely for the purpose of providing the Service to you.
- You are solely responsible for ensuring that Your Content complies with all applicable laws, including data protection laws relevant to your jurisdiction.
- You must not upload content that infringes any third-party intellectual property rights.
- You must not upload content that contains personal data about individuals without a lawful basis for processing that data.
- Tenant and owner personal data stored in the Service must be handled in accordance with applicable privacy laws. You, as the property manager, are the data controller for such data.
9. Multi-tenant data isolation
The Service is a multi-tenant platform. Each workspace operates on an isolated database. You must not attempt to access, read, modify or delete data belonging to any other workspace or customer. Any attempt to do so will be treated as a serious breach of these Terms and may result in immediate account termination and referral to relevant authorities.
10. Subscription, billing and payments
- Paid subscriptions are billed monthly or annually in advance depending on your selected plan.
- All prices are stated in AED unless otherwise specified. We reserve the right to change pricing with 30 days’ notice.
- Payments are processed via our third-party payment provider (Stripe). We do not store your full payment card details.
- Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date.
- Downgrading your plan does not entitle you to a refund for the current billing period.
- If a payment fails, we will notify you and attempt to retry the charge. Persistent payment failure may result in service suspension.
- Online rent collection processed through the platform is subject to a 2.5% transaction fee per payment, charged to the property manager. The fee is capped at AED 500 per transaction regardless of the payment amount. Fixed payment processing fees are absorbed by OperateProperty. This fee applies to card and online payments processed through our payment provider (Stripe). Payments recorded manually in the system are not subject to this fee. The AED 500 cap applies to transactions denominated in AED. For transactions in other currencies, an equivalent cap based on prevailing exchange rates will apply.
11. Service availability and support
We aim to maintain high availability of the Service but do not guarantee uninterrupted access. Planned maintenance will be communicated in advance where possible. We are not liable for losses resulting from downtime, interruptions or data unavailability.
Support is provided by email at [email protected]. Response times vary by subscription tier. Priority and dedicated support are available on Premium and Enterprise plans respectively.
12. Intellectual property
The Service, including its software, design, trademarks, logos and all associated content produced by us, is the exclusive property of OperateProperty and is protected by intellectual property laws. You may not copy, modify, distribute, sell or lease any part of the Service, nor may you reverse engineer or extract the source code of the software.
13. Privacy and data protection
Information we collect
When you register and use the Service, we collect the information you provide (name, email address, company name, workspace subdomain) and data generated through your use of the platform (properties, tenants, leases, invoices, documents and related records).
Cookies
We use cookies to maintain your login session, remember display preferences and support platform functionality. Login session cookies persist for two days by default, or two weeks if you select “Remember Me”. You can control cookie behaviour through your browser settings, though disabling cookies may affect platform functionality.
Media uploads
If you upload images to the Service, you should avoid uploading images with embedded location data (EXIF GPS). We recommend stripping location metadata from images before uploading.
Who we share your data with
We do not sell your data. We share data only with trusted third-party service providers necessary to operate the Service, including our cloud infrastructure provider (Microsoft Azure), payment processor (Stripe), and email delivery service. Each provider is bound by a data processing agreement.
Data retention
Account data is retained for the duration of your subscription plus 30 days following cancellation. Certain records may be retained longer where required by law or for legitimate security and fraud prevention purposes.
Your rights
You have the right to access, correct, export or request deletion of your personal data. To exercise these rights, contact us at [email protected]. We will respond within 30 days. Note that we may be unable to delete data we are legally required to retain.
Where your data is stored
The Service is hosted on Microsoft Azure Kubernetes Service. Data may be processed in data centres located outside your country of residence. By using the Service, you consent to this transfer and processing.
14. Limitation of liability
To the fullest extent permitted by applicable law, OperateProperty shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of or inability to use the Service, including but not limited to loss of data, loss of revenue or loss of business opportunity. Our total aggregate liability to you shall not exceed the amount paid by you to us in the 12 months preceding the claim.
15. Indemnification
You agree to indemnify, defend and hold harmless OperateProperty and its officers, directors, employees and agents from and against any claims, damages, losses, liabilities and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.
16. Changes to these Terms
We may update these Terms from time to time. We will notify you of material changes by email or by displaying a notice in the platform. Continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.
17. Governing law
These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of the relevant jurisdiction. For users based in the UAE, UAE law applies.
